USPTO Issues Decision in Favor of Boyle Fredrickson Client National Graphics

On September 12, 2014, the USPTO issued a decision in Dynamic Drinkware LLC v. National Graphics, Inc. in favor of Boyle Fredrickson client National Graphics, Inc.  Case IPR2013 – 00131, Patent 6,635,196. In its decision, the Patent Trial and Appeal Board (PTAB) found that the, “Petitioner has not demonstrated, by a preponderance of the evidence, that claims 1 and 12 of the ʼ196 patent are anticipated by Raymond under 35 U.S.C. § 102(e),” thereby upholding the validity of the patent.

This case represents a significant victory — especially because fewer than 25 percent of PTAB proceedings find that the petitioner failed to show all of the instituted claims were unpatentable.
